The Federal Communications Commission (FCC) recently ruled in response to a request for clarification that if a “platform is not capable of originating a call or sending a text without a person actively and affirmatively manually dialing each one, that platform is not an autodialer and calls or texts made using it are not subject to the TPCA’s restrictions on calls and texts to wireless phones.”

This is great news, but be careful: some peer-to-peer texting platforms also offer blast-texting. While these platforms may have P2P texting capabilities, if it also has the functionality to autodial, it may not be compliant software.
